The petitioners claim to have purchased a residential flat comprising a area measuring about 1,600 sq.ft. and have applied before the Siliguri Municipal Corporation for mutating his name in the assessment register.
The Learned Advocate appearing for the petitioners submits that the petitioners submitted the said application for mutation on 29th May, 2023 and such application has been kept pending till date. Mr. Dhar, learned Advocate for the corporation submits that the petitioners were directed to contact the office of the corporation on 12th June, 2023 and the authorized agent of the petitioners contacted the office on the said date when he was informed that a
sum of Rs.1,65,500/- is due on account of arrear property tax which is to be deposited by the petitioners before their prayer for mutation can be considered.
The learned Advocate for the petitioners submits that the corporation have not specified the head in respect of which the aforesaid sum is being demanded by the corporation.
Since the application for mutation which has been submitted on 29th May, 2023 is still pending, WPA 2898 of 2023 is disposed of by directing the Commissioner, Siliguri Municipal Corporation being the 2nd respondent to consider the application for mutation and to dispose of the same by passing a reasoned order upon affording an opportunity of hearing to the petitioners and/or their authorized representative and communicate such order to the petitioners.
The entire exercise shall be completed within a period of four weeks from the date of receipt of the server copy of this order.
Needless to mention that the petitioners will be entitled to raise all contentions in respect of their claim for mutation at the said hearing.
