The petitioner who is an Assistant Teacher of a High School situated at Rajabhat in the District of Jalpaiguri (Now Alipurduar) has submitted an application for general transfer on 02.11.2023 before the District Inspector of Schools (SE), Alipurduar. The learned advocate appearing for the petitioner submits that such application is pending for consideration before the concerned DI.

In view thereof, without entering into the merits of the prayer for transfer, this court directs the District Inspector of Schools (SE), Alipurduar, being the 4th respondent in this writ petition, to consider the prayer of the petitioner for transfer as contained in the representation dated 02.11.2023

and to dispose of the same by passing a reasoned order in accordance with the relevant Rules, Regulations and Notifications and communicate such decision within a period of four weeks from the date of receipt of the server copy of this order.

Needless to mention that in the event the DI decides in favour of the petitioner, he shall immediately forward the records including his decision to the Chairman, School Service Commission and the Chairman, School Service Commission shall take a decision on such issue as expeditiously as possible but positively within a period of four weeks from the date of receipt of the papers from the concerned DI.

With the above directions, WPA 2902 of 2023 stands disposed of.

There shall be no order as to costs.

Urgent certified copy of this order, if applied for, be given to the learned advocates for the parties on usual formalities.
