The petitioner submits that on the previous occasion, the petitioner has filed a writ application being WPA 1510 of 2023 and the said application has been disposed of by an order dated 9th August, 2023 by directing the respondent no.8 to consider and dispose of the appeal within one month from the date of communication of this order upon according a reasonable opportunity of hearing to all the interested parties, including the petitioner in accordance with Law. In the said order, the coordinate Bench of this
court has also made it clear that in the event, the petitioner prefers an appeal within two weeks from the date, the respondent no.8 shall deal with the same on merit without dismissing the same on the ground of limitation.
The petitioner has forwarded the order, dated 9th August, 2023 to the respondent no.8, which was duly received on 24th August, 2023. The petitioner also submits that the appeal filed by the petitioner was duly received by the respondent no.8 on 24th August, 2023.
The petitioner complaints that in spite of specific direction passed by this court and in spite of receipt of the appeal filed by the petitioner, the respondent no.8 has not disposed of the appeal.
Considered the submission made by the counsel for the respective parties.
This court finds that no purpose will be served by keeping the writ petition pending.
Accordingly, the writ petition is disposed of by directing the respondent no.8 to dispose of the appeal filed by the petitioner on 18th August, 2023, which was duly received by the office of the respondent no.8 on 24th August, 2023 within a period of four weeks from the date of receipt of this order, if not already disposed of.
It is made clear, if the appeal is disposed of, the same be communicated to the petitioner within a week from the date of passing of the order.
In view of the above, WPA 2915 of 2023 is disposed of.
