... for Appellants The Court : By consent of the parties, the appeal and the application are treated as on the day's list and disposed of by this order. In an appeal preferred by the State of West Bengal against an order and judgment dated 24th June, 2013 by which the West Bengal Tax on Entry of Goods into Local Areas Act, 2012 was declared ultra vires the Constitution of India, an application has been filed by the petitioner to opt for settlement of

disputes as contemplated under Section 4A of the West Bengal (Settlement of Disputes) Act, 1999. The petitioner submits that with a view to put an end to the controversies and to avail of the option which has been introduced recently by way of amendment by the West Bengal Taxation Laws (Amendment) Act, 2017, the petitioner is willing to opt for the settlement of disputes as contemplated under Section 4A of the said Act.

Mr. Abhratosh Majumder, learned Additional Advocate General submits that the appellants have no objection in the event the prayer is allowed. On such consideration, there shall be an order in terms of prayer (a) of the application.
