The Court :- Affidavit in opposition filed in Court be taken on record. This application under Section 9 of the Arbitration and Conciliation Act, 1996 is taken up for consideration subsequent to the order dated February 15, 2021.

There subsists an interim order dated January 18, 2021. The respondent no. 2 filed an affidavit. The respondent no.1 is unrepresented today. Despite direction for filing affidavit, the respondent no.1 did not use any affidavit.

Learned Advocate appearing for the petitioner submits that, the petitioner made a reference under Section 21 of the Arbitration and Conciliation Act, 1996. In such circumstances, it would be appropriate to dispose of the present application by confirming the interim order dated January 18, 2021.

Needless to say that, the parties to the arbitration agreement are at liberty to apply before the learned Arbitrator for appropriate relief. AP No. 2 of 2021 is disposed of accordingly.
