The Court:- This is an application for dissolution of the company (in liquidation).

By an order dated 3 December, 1958, the company namely H.B. Industrial Development Company Limited was directed to wound up and the Official Liquidator was appointed in respect of the assets and properties of the company. It is submitted on behalf of the Official Liquidator that no steps have been taken in the liquidation proceedings.

There are no assets nor properties of the company (in liquidation). All liabilities of the company (in liquidation) have also been paid up. The present fund position of the company (in liquidation) is also NIL.

I have considered the averments made in this application. In view of Rule 282 of the Companies (Court) Rules 1959 read with section 481 of the Companies Act, 1956 there shall be an order in terms of prayer (a) of the Judge's Summons. Insofar as prayer (b) is concerned, it is fairly submitted on behalf of the Official Liquidator that the same is infructuous and need not be considered. To the aforesaid extent, CA/13/2023 stands allowed. CP/245/1958 also stands disposed of.
