The Court: The Affidavit of Assets filed on behalf of the judgment-debtor be kept with the record.
It appears from the said Affidavit of Assets that the judgment-debtor is entitled to receive an amount of approximately Rs.463 crores by way of arbitral proceedings, details whereof would appear at paragraph 12 of the said Affidavit. Mr. Banerjee appears on behalf of the decree-holder fairly submits that, at this stage, there is no scope for any order save and except the order of injunction in respect of the details furnished at paragraph 12 of the Affidavit. In view of the aforesaid, there shall be an order of injunction restraining the award-debtor, their men, servants and assigns from utilizing any amounts out of the sums enumerated in paragraph 12 of the Affidavit without keeping aside and making payment of the entire decretal dues of the decree-holder. With the above directions, EC No.3 of 2021 is disposed of. Liberty is granted to the decree-holder to apply for further orders if the circumstances so warrant.
It is made clear that the decree-holder will furnish all the particulars of the arbitral proceedings which have been enumerated in paragraph 12 of the affidavit and the status of such proceedings to the decree-holder within a period of four weeks from date.
