The Court: Counsel for the respective parties are present. The plaintiff has filed the present application seeking leave to withdraw the instant application so that the plaintiff can withdraw the amount from the bank and distribute all the legal heirs. Counsel for the petitioner submits that as there is a settlement between the parties and as such the plaintiff intends to withdraw the suit. Counsel for the caveator/defendant raised no objection for withdrawal of the suit.

In view of the submission made by the Counsel for the plaintiff, TS No. 2 of 2015(PLA No. 172 of 2013) is withdrawn in terms of Prayer (a) and (b) of the present application.
