... for the plaintiff The Court : It has been submitted by learned counsel appearing for the plaintiff who is the sole beneficiary of the Will of the deceased dated 26th October, 2002 that the translated version of the original Will is required to be issued afresh since the translated version is in a tattered condition. Counsel submits that the Testamentary Department is required to be granted leave to make a fresh copy of the translated version of the Will. Counsel prays that the fresh copy should also be issued to the plaintiff. Upon seeing the original Will as well as the condition of the translated copy, this Court is of the view that leave should be granted to the

concerned Department to make a fresh copy of the translated version of the Will of the deceased.

The Department is directed to make a fresh copy of the translated version within two weeks from the date on which the Court reconvenes in January, 2021.

A copy of the fresh translated version of the Will should be made available upon the plaintiff applying for the same before the Department. (MOUSHUMI BHATTACHARYA, J.) RS
