Though the matter is fixed today as "presentation of Plaint" but the learned Counsel for the plaintiff has submitted that there is some defects in the plaint and the plaintiff has also obtained some documents which are required to be disclosed in the plaint. Thus, the same cannot be cured by way of amendment.

Accordingly, the plaintiff prays for withdrawal of the plaint with the liberty to file afresh.

Considered the submissions made by the Counsel for the plaintiff. Liberty is granted to the plaintiff to withdraw the plaint with liberty to file afresh on the self-same cause of action.
