For KMC The Court:- It is submitted by learned Counsel appearing for the appellant nos. 2, 3 and 4 on one hand and respondent nos. 1 and 2 on the other that those parties have settled the disputes between them. The two suits filed by the appellant nos. 2, 3 and 4 against the aforesaid respondents in the City Civil Court at Kolkata have been compromised. Internet copies of the orders evidencing such compromise, filed in Court today, be kept with the records.

In that view of the matter, the appellants say that they do not wish to proceed with this appeal.

Accordingly, the appeal and the connected applications stand disposed of.

Mr.

Mitra, learned Advocate representing Kolkata Municipal Corporation, reminds this Court that a portion of the building in question is in a dangerous condition and order under Section 412A of KMC Act, 1980, has already been issued. The owners of the building shall forthwith remove/demolish the dangerous portion of the building to avoid any untoward incident. .
