The petitioner has preferred the present petition under Section 29A of the Arbitration and Conciliation Act, 1996, seeking extension of the mandate of the Arbitral Tribunal for completion of the arbitral proceedings and publication of the arbitral award.
Learned Counsel for the petitioner submits that vide order dated 19.01.2023 this Court appointed a learned sole Arbitrator to adjudicate the disputes between the parties. The learned Arbitrator expressed his inability to continue with the arbitration proceedings and recused himself. Thereafter, this Court vide order dated 01.05.2023 appointed another sole Arbitrator to adjudicate the disputes between the parties. The pleadings
were completed on 22.05.2024. Due to ill health, the said Arbitrator resigned vide letter dated 26.06.2024. Another Arbitrator was appointed by this Court vide order dated 30.09.2024. Thereafter, the parties consented to the extension of the mandate of the Arbitral Tribunal by six months till 21.11.2025. The said time period has expired and the petitioner has preferred the present petition for extension of the mandate of the Arbitral Tribunal. Learned Counsel for the petitioner submits that the Tribunal has held more than 15 sittings and has decided applications under Sections 17 and 16 of the Arbitration and Conciliation Act, 1996. Upon consideration of the submissions of both the parties and the materials placed on record, this Court is satisfied that there has been no undue or unwarranted delay on the part of the learned sole Arbitrator in conducting the proceedings.
Having regard to the advanced stage of the proceedings and in the interest of justice, the mandate of the learned sole Arbitrator is extended further for a period of eight months from today. The learned sole Arbitrator is requested to make all reasonable endeavours to conclude the arbitral proceedings and publish the arbitral award within the extended time period.
