The Court: Pursuant to an earlier direction of Court, the Food Corporation of India is duly represented. The Divisional Manager of the Corporation, Mr. Indranil Mandal is present in Court and submits that he has obtained instructions in terms of the earlier order of Court. The crux of the disputes between the parties arises out of a tenancy agreement in respect of a godowns situated at Budge Budge as well as Belgharia, belonging to the plaintiff Budge Budge Company Limited. The suits have been pending since 1981 and have been repeatedly adjourned on one pretext or the other.
On behalf of the respondent Corporation, it is submitted that in terms of the earlier orders of Court, they are ready and willing to settle both matters by making payment of a sum of Rs.15 lakhs to the plaintiff Budge Budge Company Limited in full and final settlement. It is made clear that the above amount of Rs. 15 lakhs would include all claims (including interest). The respondent Corporation undertakes to make such payment within 15 days from date. In order to make such payment, the Budge Budge Corporation Limited undertakes to furnish all necessary bank details to the Advocate appearing on behalf of the Corporation within 48 hours.
In view of the above, nothing survives in these suits. Interim orders, if any, stand vacated.
Accordingly, both suits i.e.
CS-COM/578/2024 and CSCOM/657/2024 stand disposed of.
