The Court:- The petitioner has preferred the present petition under Section 29A of the Arbitration and Conciliation Act, 1996, seeking extension of the mandate of the arbitral tribunal for conclusion of the arbitral proceedings and publication of the arbitral award. Learned counsel for the Petitioner submits that, by an order dated 07.02.2024, this Hon'ble Court appointed a learned Sole Arbitrator to adjudicate the disputes between the parties. Thereafter, with the consent of the parties, the mandate of the Arbitral Tribunal was extended for a further period of six months up to 12.06.2025.

It is further submitted that the Arbitral Tribunal has held 24 sittings, the evidence of both parties stands concluded, and the Claimant has already concluded its final arguments. The matter is presently fixed for the Respondents' arguments. However, at that stage, the Respondents filed an

application seeking leave to adduce additional evidence, which is presently under consideration of the Arbitral Tribunal. In view of the aforesaid circumstances, learned counsel for the Petitioner seeks extension of the mandate of the Arbitral Tribunal for a further period of six months to enable conclusion of the arbitral proceedings and publication of the arbitral award.

Learned counsel for the respondents' states that he has no objection to the present application.

Upon consideration of the submissions of the parties and the materials placed on record, this Court is satisfied that there has been no undue or unwarranted delay on the part of the learned sole arbitrator in conducting the proceedings. Having regard to the advanced stage of the arbitral proceedings and in the interest of justice, the mandate of the arbitral tribunal is further extended for a period of six months from today. The learned sole arbitrator is requested to make all reasonable endeavours to conclude the proceedings and publish the award within the extended time period.

With the aforesaid direction, the present petition stands disposed of. (GAURANG KANTH, J.) R. D. Barua
