The Court : The son of the testator out of his first marriage initially did not give consent, as a consequence whereof citation was issued on him. Despite receipt of citation no caveat was lodged. The department had issued a no caveat certificate. Prior to issuance of such certificate the said son has, however, consented to the grant.

In the aforesaid facts and circumstances, let probate of the last Will and testament dated 8th August, 2017 with effect throughout the State of West Bengal be granted to the executrix/applicant in terms of prayer (a) of the petition.
