The Court: The application is not maintainable at the instance of the petitioner. The petitioner is an awardee in another arbitration proceeding. The award in favour of the petitioner was that, any sum that may be awarded to the Sahaj e-Village in the arbitration proceeding between the State of West Bengal and Sahaj-e-Village, will be a receivable of the petitioner. However, the learned advocate representing the Resolution Professional assures the Court that immediate steps will be taken for extension of the mandate of the learned Arbitrator, so that the arbitration proceeding between the

State of West Bengal and Sahaj e-Village Kendra may continue and the Resolution Professional shall represent Sahaj e-Village Kendra before the learned Arbitrator.

Mr. Saha submits that the petitioner is willing to bear the cost of the arbitration and to render all cooperation to the Resolution Professional. All the disputes which are before the NCLT and other objections etc. may be placed before the learned Arbitrator upon extension of the mandate, to enable the learned arbitrator to take a decision on those issues.
