The Court :- Learned Advocate appearing for the petitioner submits that, the petitioner made a reference of the disputes to the arbitrator. He submits that, the possession of the assets is with the Receiver. In view of the reference, he submits that, the present application under Section 9 of the Arbitration and Conciliation Act, 1996 be disposed of. Learned Advocate appearing for the respondents submits that, the disputes may be adjudicated upon by the learned Arbitrator. In view of the reference made, it would be appropriate to dispose of the present application. Learned Arbitrator is at liberty to issue directions with regard to the possession of the assets as the learned Arbitrator may deem appropriate.

Learned Arbitrator will issue necessary direction with regard to the discharge of the learned Receiver and his remuneration also. AP No. 42 of 2021 is disposed of accordingly. (DEBANGSU BASAK, J.) snn.
