The Court:

This is a suit is for infringement of copyright of the works of Samabeta Upasana, Hari Om Kirtan, and Swarupananda Sangeet over which the petitioners claim exclusive rights.

By an ad interim order dated 27 January, 2025, the respondents were restrained and directed to remove the offending content from their respective sites. It is fairly submitted on behalf of the petitioner that the grievances raised by the petitioners have been practically resolved. The offending contents have been deleted from all the impugned sites. The defendant no. 4 is also represented and submits that all the impugned contents have been removed and deleted.

In view of the above, no purpose would be served in proceeding with the suit any further.

The plaintiff is granted liberty to give the full and exact particulars of any other offending or any identical content which forms the subject matter of the suit. The defendant nos. 1 and 2 and the defendant no. 4 undertake to take necessary and appropriate steps if and when the plaintiff provides them with any further offending content.

In view of the above directions, nothing survives in the suit. By consent of the parties, GA-COM/1/2025 and IP-COM/9/2025 stand disposed of.

The ad interim order dated 27 January, 2025 stands confirmed. In view of the formal prayers sought for on behalf of the plaintiff and the defendant no. 1, the name of the defendant no. 1 i.e. Youtube India also stands deleted.

Let a decree be drawn up in terms of the above. (RAVI KRISHAN KAPUR, J.) SK.
