...for the award debtor The Court :- Learned Senior Advocate appearing for the award holder submits that, the Appeal Court passed an order staying the execution proceedings conditional upon deposit of amount directed. He submits that in such view, the award holder does not wish to proceed with the present execution petition. However, leave may be granted to the award holder to apply for execution subsequently.

The award debtor is represented.

In the facts of the present case, since the award holder does not wish to proceed with the present execution petition at this stage, E.C. No. 23 of 2021 is dismissed as withdrawn with liberty to file afresh on the selfsame cause of action. Interim orders, if any, stand vacated.
