The Court:- This is an application for extension of the mandate of the learned arbitrator. The mandate of the learned arbitrator expired on 21st January, 2025. It is the contention of the petitioner that, arguments on behalf of the claimant were complete and the learned arbitrator closed the arguments of the respondent, on the ground that the respondent had failed to advance argument on three occasions.
Mr. Mainak Bose, learned Senior advocate appears on behalf of respondent and submits that the mandate is required to be extended. It is also submitted that, the petitioner prays for extension of the mandate to enable publication of the award. The respondent seeks extension for further
adjudication of the interlocutory application and final conclusion of the proceeding. The respondent challenged an interlocutory order of refusal to appoint a handwriting expert in a civil revision, which is pending. The prayer of Mr. Bose's client in the civil revision is that, the order passed by the learned arbitrator rejecting the prayer for appointment of the handwriting expert should be set aside and the application should be remanded for hearing of the same afresh.
Considered the rival of contentions. One aspect is clear, i.e., both parties require the mandate to be extended for complete adjudication of the disputes. Accordingly, this application is allowed, by extending the mandate of the learned arbitrator by a further period of six months from the date of communication of this order.
