However, in the meantime, the parties decided to settle the dispute amicably out of Court and the appellants, therefore, intend not to proceed with the instant appeal and pray for withdrawal of the same.

The instant appeal arises from revocation of leave under Clause 12 of the Letters Patent and directing the plaint to be returned for presentation before the appropriate forum. We do not find any impediment

in allowing the prayer for withdrawal. The deed of settlement has also been filed by the parties, which is kept on record. In view of the above, the appeal is dismissed as withdrawn. Interim order, if any, stands vacated.
