For petitioner The Court : The caveat lodged to oppose the Will, the grant of probate of which has been sought for in this application, was discharged by an order dated 17th February, 2023.

After the discharge of the caveat, there is no objection as against the grant. No Caveat Certificate has been issued by the department. The Will has been proved in common form by the affidavit of the attesting witness filed in the proceedings.

Considering the view of the department upon complete scrutiny, the application for grant of probate is allowed by granting order in terms of prayer (d) of the petition.
