The matter is being taken up out of turn upon being mentioned with notice by the judgment-debtor.

Learned counsel for the judgment-debtor submits that all payments have been made in the meantime in terms of the settlement arrived at between the parties.

It appears from the order dated October 17, 2023 recorded by a coordinate Bench that the parties have settled their disputes during the pendency of the proceeding and the settlement agreement was also kept on record.

Thus, in view of the submission of the judgment-debtor that all payments in terms of the settlement have been made, nothing remains to be adjudicated further in the present execution application. Accordingly, EC/42/2019 is disposed of as infructuous in the light of the above observations.
