Learned advocate representing the Corporation submits, upon instruction that, challenging the order of demolition passed by the Special Officer [Building], Kolkata Municipal Corporation a statutory appeal before the learned Municipal Building Tribunal was filed by the petitioner being B. T. Appeal No.195 of 2023. A direction has been passed by the learned Municipal Building Tribunal on 30.01.2024 directing the Corporation not to take any coercive steps till disposal of the stay application and the next date has been fixed for hearing of the stay petition on 15.03.2024. As the petitioner remains unrepresented, accordingly, the matter stands dismissed for default.

Instruction forwarded by the engineers of the Corporation be retained with the record.

Learned Municipal Building Tribunal is requested to dispose of the stay application by 28.03.2024 and the appeal by 24.05.2024. The department is directed to take immediate steps for transmitting the case records to the learned Municipal Building Tribunal so that there may not be any delay in hearing of the appeal.
