Report is filed in the form of affidavit affirmed on 3rd February, 2026 on behalf of Eastern Coalfields Ltd. (for short, ECL) and same is taken on record.

Learned advocate representing ECL has drawn attention of this court to pages 6 and 7 of the said report and it is submitted that vide letter dated 8th December, 2025 petitioner was appointed on compassionate ground due to death of his father, who was an employee of ECL. It is also submitted that petitioner has joined the post in terms of appointment letter dated 8th December, 2025.

Learned advocate representing the petitioner submits that there is considerable delay in granting appointment on compassionate ground. As such, petitioner is entitled to receive salary prior to date of his appointment.

The writ petition was filed seeking appointment on compassionate ground due to death of petitioner's father. Steps were taken by the concerned authority of ECL not contemporaneously, but belatedly and

in terms of the relevant scheme relating to appointment on compassionate ground, petitioner was permitted to join the post by issuing appointment letter dated 8th December, 2025. This court appreciates the grievance of the petitioner relating to the delay caused in appointing the petitioner on compassionate ground, but prayer for payment of salary for the period when petitioner did not discharge duty ought not to be allowed.

Having found that petitioner is appointed on compassionate ground it further appears that grievance of the petitioner is substantially redressed.

Writ petition stands disposed of.
