The Court: Mr. Partha Ghosh, learned Advocate appears for the petitioner. Ms. Amrita Pandey, learned Advocate appears for the ECL. The petitioner being the widow of the deceased employee of ECL claims the monetary compensation (MMCC), under the Policy of the Coal Company since the employee dies during his employment tenure.

In all fairness ECL has agreed to pay the MMCC component in accordance with law to the petitioner from the date of the application being January 5, 2011 Annexure P-4 at page 37 to the writ petition. Mr. Partha Ghosh, learned Advocate Counsel appearing for the petitioner on instruction from his client submits that the petitioner is agreeable for the said proposal of the ECL.

In view of the above, the MMCC compensation payable to the petitioner in accordance with law shall be paid by the appropriate authority of the ECL positively within a period of Two Months from the date of communication of this order.

In default, ECL shall pay interest @ 6% p.a. from the date of the said application until the actual payment shall be made to the petitioner. Since affidavits are not called for, the allegations made in this writ petition are deemed not to have been admitted by the respondents. The instructions received by the respective learned Counsel from their clients placed before this Court are taken on record. This writ petition being WPO/67/2025 is disposed of. (ANIRUDDHA ROY, J) dg/
