The Court:- In view of the order passed by the Hon'ble Division Bench in APOT No.78 of 2024 with WPO No.71 of 2024 IA NO:GA/1/2024, GA/2/2024 [Rahul Kumar Yadav & Ors. Vs. Gopinath Sircar], the appellants before the Hon'ble Division Bench are directed to be added as party respondents in the instant writ petition. The details of the appellants shall be handed over to this Court for the department to make the necessary amendment in the cause title of the writ petition. Copy of the writ petition shall be served upon the added respondents. The Hon'ble Division Bench disposed of the appeal by passing certain directions. The appellants i.e., the added respondents herein were given liberty to approach the statutory appellate forum within a specified time period. It has been submitted by the learned advocate representing the added respondents that the statutory appeal will be filed by 7th March, 2024. The writ petitioner has been impleaded as party in the said statutory appeal.
On disposal of the appeal, there is nothing further to be adjudicated in the present proceeding. It will be open for the parties to make appropriate submissions before the appellate forum.
The Municipal Building Tribunal shall take steps in compliance of the direction passed by the Hon'ble Division Bench on February 27, 2024. The writ petition stands disposed of.
