The Hon'ble JUSTICE ARINDAM MUKHERJEE Date: 4th October, 2021 The Court : The petitioner in this contempt petition remains unrepresented. No one also appears on behalf of the alleged contemnors. It appears from paragraph 8 of the contempt petition that on 15th January, 2004 as per the direction given by the Hon'ble Justice Barin Ghosh, the contempt petition was filed. The contempt petition was filed on 22nd January, 2004 and is pending since then. Records reveal that the same appeared on 30th September, 2021 when no one appeared on behalf of the petitioner. Again on 1st October, 2021 when the matter was called on, no one appeared on behalf of the petitioner. Even today no one appears on behalf of the petitioner. It appears that the petitioner is not interested in proceeding with the matter.

The contempt as alleged arises out of a communication said to have been issued by the learned Advocate representing the private respondents in a writ petition filed by the petitioner herein. No particulars of the writ petition has, however, been provided in the contempt petition. There is also

no order dated 15th January, 2004 annexed to the petition. Unless the petitioner comesforth and explains the act of contempt, the Court cannot also go into the merits of the matter. The petitioner after being afforded adequate opportunity does not come before the Court to explain the alleged act of contempt.

In such circumstances, the contempt petition is disposed of without any further order.

Rule, if any, stands discharged.
