Learned advocate representing the State respondents has produced written instruction from the Officer-in-Charge, Gariahat Police Station dated 20th February, 2025 wherefrom it transpires that the name of the petitioner has been found to the recorded in Bhowanipore Police Station Case No.69 dated 14th February, 2012 under Section 406 IPC and that charge sheet vide C/S No.461/12 has been submitted on 5th January, 2013 against Tarun Kumar Chakraborty and the proceeding is pending before the learned Chief Judicial Magistrate at Alipore.

Learned advocate representing the State respondents is directed to file a report by way of affidavit disclosing the details and the up-to-date status of the criminal case pending against the petitioner. Such affidavit shall be affirmed by the competent officer of the State. Copy of the same shall be circulated by 28th March, 2025.

As it appears that the respondent authorities are located outside the Original Side jurisdiction of this Court, the instant writ petition shall be converted to the Appellate Side with a new number.

The writ petition in the Original Side be treated as disposed of. 5.

Let the matter appear in the Appellate Side list on 8th April, 2025 under the heading 'adjourned motion'.
