The Court: Learned advocate appearing in support of the winding up petition submits that, the winding up petition is yet to be admitted. He relies upon 2020 SCC Online SC 1025 (Action Ispat and Power Pvt. Ltd. versus Shyam Metalics and Energy Ltd.) and submits that, the Company Court should direct transfer of the pending winding up petition to the National Company Law Tribunal, Kolkata for adjudication.

In view of paragraph 22 of Action Ispat & Power Pvt. Ltd. (supra), CP 33 of 2016 is transferred to the National Company Law Tribunal, Kolkata.

Department will treat CP 33 of 2016 as disposed of so far as the records of this Hon'ble Court are concerned.
