Mr. S. K. Sarkar, Advocate for respondent nos.5 and 6. The Court : Pursuant to the order dated 21st December, 2020 the petitioner has made a new application and an inspection has also been carried out by CESC Limited on 23rd December, 2020. It is submitted on behalf of CESC Limited that the offer letter will be issued to the petitioner within a couple of days.
Subject to the petitioner paying all costs and expenses and complying with the statutory requirements as per the offer letter, a new meter in the name of the petitioner be installed and a separate supply through the said meter from the existing main supply be given to the petitioner within 4th January, 2021. It is expected that the private respondents shall cooperate with the officials of CESC Limited at the time of installation of the new meter and giving a connection to the petitioner
through the newly installed meter in the petitioner's name. The Officer-inCharge, Muchipara Police Station (respondent no.4) shall ensure that no breach of peace takes place at the said premises and/or in its precincts at the time when the officials of CESC Limited shall install a new meter to give connection to the petitioner.
Installation of new meter or grant of new connection shall not create any new right or abridge or extinguish any existing right of the petitioner in respect of the premises in question.
Nothing further remains to be adjudicated in the writ petition. The same is accordingly disposed of without any order as to costs. Since I have not called for any affidavit, the allegations contained in the petition are deemed to have not been admitted by the respondents. ( ARINDAM MUKHERJEE, J.) pa
