The Court:-The issue of unauthorized construction was taken up for consideration by the Special Officer (Building), Kolkata Municipal Corporation. By an order dated 7th May, 2021, the said Special Officer (Building) disposed of the prayer of the petitioner and passed an order under Section 400(1) of the Kolkata Municipal Corporation Act, 1980 by directing demolition of the unauthorized portion.

Learned Advocate appearing on behalf of the petitioner submits that an appeal has been preferred by the person responsible before the Municipal Building Tribunal and the same is pending consideration.

In view of the above, as the relief sought for by the petitioner has already been granted by the Special Officer (Building), accordingly, there is no requirement of proceeding with the writ petition any further. The writ petition stands disposed of.

The order dated 7th May, 2021 passed by the Special Officer (Building) of the Kolkata Municipal Corporation filed in Court today is taken on record.
