The Court :- It is submitted by the learned advocate representing the plaintiff that Ms. Sushmita Choudhury, learned advocate on record for the plaintiff, has received an instruction from her client vide an electronic mail dated 19th February, 2024 for withdrawal of the suit along with the pending injunction application.

It is also stated in the said electronic mail placed before the Court that a meeting was held on 8th February, 2024 between the parties wherein a minute was drawn up. A copy of the said minutes, which is signed by the officers of the plaintiff and the defendant, is also attached with the mail. The mail with such attachment is taken on record.

It is also submitted by the learned advocate for the plaintiff that the application for injunction being IA No. GA/1/2023 has been dismissed for default on 19th February, 2024 and as such there is no application pending in the suit.

The suit is dismissed as withdrawn as there has been full and final settlement of the claim and counter claim and all issues in the suit as provided in the minutes of the meeting dated 8th February, 2024. (ARINDAM MUKHERJEE, J.) snn
