Counsel for the plaintiff has handed over the copy of the order passed by the Hon'ble Appellate Court in APD no. 43 of 2018 dated 2nd September, 2019 wherein the Hon'ble Appellate Court has referred the disputes to the learned Arbitrator. Counsel for the plaintiff has already communicated the order to the learned Arbitrator. In view of the above as the Arbitrator is appointed to adjudicate the disputes between the parties, nothing remains in the suit. In view of the order passed by the Hon'ble Appellate Court dated 2nd September, 2019, CS 14 of 2017 is disposed of.
