The Court :- The deceased testator was a hindu during his life time. The Class-I and Class-II heirs/heiresses of the testator under the provisions of Hindu Succession Act, 1956 have pre-deceased him. The applicant is the niece being the daughter of one of the brothers of the testator, namely, Kamalesh Raychowdhury. There is as such no objection to the grant. Considering the view of the department upon complete scrutiny, the application for grant of probate is allowed by granting order in terms of prayer (b) of the application.
