The Court: The execution application has been pending since 2005. It is submitted on behalf of the decree-holder that in a connected suit between the same parties arising out of the Terms of Settlement, an appeal is pending.

There is also a contempt petition filed which is pending. This order is passed without prejudice to any of the rights of either of the parties in either of the above mentioned proceedings. It is submitted on behalf of the respondent that there has been compliance with the decree since 2006. This fact would also appear from a Supplementary Affidavit which has been filed on behalf of the respondent. It is also submitted on behalf of the respondent that they shall abide with the Terms of Settlement already filed.

In view of the aforesaid, nothing survives in this application. EC/11/2005, stands disposed of.
