The Court:- The petitioner challenges the notice issued under Section 401 of the Kolkata Municipal Corporation Act,1980 restraining the petitioner from carrying on any construction work as the same was being made without any sanction at a portion of the premises no.170[Portion], Ahiritola Street, Ward No.19, Borough II, Kolkata-700005.

It appears from the submissions made on behalf of all the parties that the unauthorised construction of the C.I. shed supported with iron post with frame & brick work in the ground floor has already been demolished by the Corporation.

After demolition of the unauthorised construction the Corporation has revoked the notice under Section 401 of the Act.

Right now, the very purpose for filing the writ petition, does not survive. No further issue is required to be decided in the instant writ petition. The same stands disposed of.
