Counsel for the petitioner has filed affidavit-of-consent of one of the legal heirs, namely, Usha Sunil Kejriwal, wife of Sunil Kejriwal and daughter of late Satyanarayan Rungta. Counsel for the petitioner submits that Smt. Usha Sunil Kejriwal being the legal heirs of deceased Krishna Devi Rungta is a resident of Mumbai, Maharashtra and is not in a position to appear before this Court in person and as such she has executed an affidavit by giving consent for grant of Letters of Administration to the petitioners to the estate of the deceased Krishna Devi Rungta. Considering the peculiar situation of the petitioner, the affidavit affirmed before the Notary Public at Mumbai is accepted as special circumstances.

The petitioners have filed the instant application for grant of Letters of Administration to the estate of the deceased Krishna Devi Rungta. The deceased died leaving behind two sons, one daughter in-law and two

daughters. All the legal heirs have submitted their consents for grant of Letters of Administration to the petitioners. Perused the application, affidavit of the legal heirs. This Court finds that there is no impediment for grant of Letters of Administration to the petitioners to the estate of deceased Krishna Devi Rungta.

In view of the above, prayer (a) of the instant application is allowed subject to furnishing of personal bond of Rs.3,25,000/- with one surety. PLA/71/2020 is disposed of.
