...for the B.O.I The Court: Learned Counsel for the petitioner submits that the petitioner seeks to withdraw the present petition with a view to initiate arbitration proceedings by issuing a notice under Section 21 of the Arbitration and Conciliation Act, 1996.

In view of the above, the petitioner is permitted to withdraw the present petition with liberty as prayed for.

It is clarified that this Court has not adjudicated upon the merits of the case and any fresh proceedings that may be initiated by the petitioner shall be considered and decided in accordance with law. Accordingly, the present petition is dismissed as withdrawn. All interim orders, if any, stand vacated.
