By a letter dated 28th February 2008 the defendant has communicated to the plaintiff informing them that the defendant has stopped using the impugned mark and categorically undertakes not to do so in the future. The defendant remains unrepresented.

In view of the letter dated 28th February 2008, nothing survives in this suit. CS/23/2008 stands disposed of.
