The petitioner has preferred the present petition under Section 29A of the Arbitration and Conciliation Act, 1996 seeking extension of the mandate of the arbitral tribunal for conclusion of the arbitral proceedings and publication of the arbitral award.

Learned Counsel for the petitioner submits that the Chairman and Managing Director of the Respondent appointed Mr. Tanmoy Roy as the sole arbitrator vide letter dated 3rd February, 2020 to adjudicate the disputes between the parties. The petitioner agreed to the said appointment. The first sitting of the arbitral proceedings took place on 2nd September, 2020 and the pleadings were completed within six months from the date of the first sitting. However, due to COVID pandemic, there was delay in the proceedings. This Court vide orders dated 9th July, 2024 and 1st May, 2025

extended the mandate of the arbitral tribunal by six months and eight months respectively.

Learned Counsel for the petitioner submits that the mandate of the arbitral tribunal has now expired on 1st January, 2026. He further states that the matter is at the stage of the final arguments and that the arbitral tribunal has already conducted more than 28 sittings. Notwithstanding the considerable delay in conclusion of the arbitral proceedings, upon perusal of the materials placed on record, this Court is satisfied that the matter is at an advanced stage of the proceeding. Accordingly, in the interest of justice and to enable culmination of the proceedings, the mandate of the learned sole arbitrator is extended for a further period of four months from today.

The learned sole arbitrator is requested to make all reasonable endeavours to conclude the arbitral proceedings and publish the arbitral award within the extended time period.

With the aforesaid observations, the present petition stands disposed of.
