The Court: Affidavit of service filed in Court be taken on record. By this application under Section 29A of the Arbitration and Conciliation Act, 1996, the petitioner seeks an order extending the mandate of the sole Arbitrator to conclude the proceedings.

Learned advocate appearing for the petitioner submits that the cross-examination of the witness of the petitioner was concluded when the time to make and publish the award expired. The respondent in the arbitration will not adduce any oral evidence. Consequently, the arguments of the parties can commence. It appears from the records that the time to make and publish the award expired on March 9, 2020.

In view of the fact that the arbitration is at the advanced stage, it would be appropriate to extend the time for the learned Arbitrator to make and publish the award. The time to do so is extended for a period of six months from date as prayed for. AP/131/2021 is disposed of accordingly.
