...For the respondents The Court : Dispensing with all formalities, we have heard out the appeal and propose to dispose of it by this order. The appellant/plaintiff's advocate-on-record will cure the defects pointed out by the department to the satisfaction of the Registrar, Original Side by 4th February, 2022.

The costs imposed by the impugned order dated 23rd December, 2021 is reduced to Rs.10,000/-. The impugned order dated 23rd December, 2021 is modified to the above extent only. In the fitness of things, we expedite the suit and the pending application (GA No.1 of 2014, Old GA No.1371 of 2014) in the following manner :

(i) The respondents/defendants shall file their written statement by 21st February, 2022.

(ii) Cross discovery of documents by the parties by 4th March, 2022.

(iii) Inspection forthwith.

(iv) The suit may thereafter be mentioned before the appropriate court for hearing.

In the meantime, the pending application (GA No.1 of 2014, Old GA No.1371 of 2014) may be mentioned by advocate-on-record for the appellant/plaintiff before the learned interlocutory judge for getting it listed and for passing appropriate orders.

The appeal (APOT No.9 of 2022) and the stay application (IA No.GA No.1 of 2022) are disposed of accordingly.
