1. The petitioner has filed the present writ application praying for direction upon the respondent authority to issue passport to the petitioner No.1 by enclosing the name of the father of the petitioner No.1 as Priyankar Saha.
2. Learned Counsel for the petitioner has applied for grant of passport by disclosing the name of her adoptive father, namely, Priyankar Saha.
3. The passport authority has not proceeded with the request of the petitioner for grant of passport due to change of the name of the father of the petitioner in the passport application.
4. Learned Counsel for the petitioner submits that the petitioner was born in the wedlock between Ms. Shreya Saha Bhattacharya and Mr. Debojyati Koley.
5. Due to the family dispute between the mother and father of the petitioner No.1, have filed suit for grant of decree of divorce and the learned Court of Additional District Judge, Kalna has granted decree of divorce between Ms. Shreya Saha Bhattacharya and Mr. Debojyati Koley.
6. The petitioner No.2 after her divorce with her husband has conducted second marriage with Mr. Priyankar Saha. Now, the petitioner intends that in her passport the name of Mr. Priyankar Saha may be included instead of Mr. Debojyati Koley.
7. By an order dated 9th June, 2026, this Court directed the petitioner to add the biological father of the petitioner as a party to the instant writ application. Accordingly, after addition of party, the biological father has filed an affidavit affirming that "he has no objection if a passport is issued recording Mr. Priyankar Saha as the father of the child".
8. Considering the affidavit filed by the biological father of the petitioner No.1, this Court is of the view that passport can be issued to the petitioner by incorporating the name of Mr. Priyankar Saha as the father of the child.
9. In view of the above, the respondent No.2 is directed to issue passport to the petitioner No.1 by incorporating the name of Mr. Priyankar Saha as father of as child within a period of four weeks from the date of receipt of the order.
10.It is made clear that this order is passed only on the basis of the affidavit filed by the biological father and it shall not be treated as precedent in future.
11.It is made clear that once the passport is issued to the petitioner No.1 by incorporating the name of Mr. Priyankar Saha as the father of the child, in further if the petitioner applies for the renewal of the passport, the same name of the father will continue in the passport.
12. WPO/80/2026 is disposed of.
