It is submitted that initially this Court has passed a decree upon judgment. The plaintiff had preferred an execution proceeding for execution of the decree passed by this Court being execution case No. EC/324/2019. During the pendency of the said execution case, parties have settled their disputes by entering into Terms of Settlement dated 29th November, 2024 and accordingly, Learned Court dealing with the execution proceeding has disposed of the execution proceeding by an order dated 2nd December, 2024.

Counsel for the defendant submits that the defendant has filed the counter claim but in view of the settlement arrived between the parties, the defendant is also not interested to proceed with the counter claim filed by the defendant.

Both learned Counsel appearing for the parties pray for disposal of CS-COM/94/2024 (Old No. CS/24/2018).

In view of the submission made by the Counsel for the respective parties as the parties have settled their disputes by entering into Terms of Settlement dated 29th November, 2024 and the execution case is also disposed of, accordingly, CS-COM/94/2024 (Old No. CS/24/2018) along with counter claim is disposed of.
