We have heard learned counsel for the parties. Inspite of directions the appellant has not filed any paper book. By our order dated 5th December 2023 we had stated that in default of filing of the paper book by the appellant the appeal may be mentioned for dismissal for non-prosecution.

Mr. Sujit Banerjee, learned advocate appearing for the appellant says that he has no instruction in the matter and be granted leave to retire.

Such leave is granted.

For failure of filing the paper book this appeal is dismissed for non-prosecution.
