The Court : The advocate-on-record appearing for the petitioner seeks to withdraw the application filed under Section 9 of The Arbitration and Conciliation Act, 1996 on the ground that an Arbitral Tribunal has already been constituted and an application under Section 17 of the Act containing similar prayers has already been moved by the petitioner in the arbitration. The respondent is represented and submits that the parties are before the Tribunal and does not object to the prayer of the petitioner. In view of the above, AP No.146 of 2021 is dismissed as withdrawn. The order dated 17th March, 2021 is vacated.
