... for private respondent no.6 It has been uniformly submitted by the learned Advocates appearing for the appellants and the respondent no.6 that the dispute between the appellants and the respondent no.6 with regard to the person liable to meet the demand raised by Kolkata Municipal Corporation on account of the property, rates and taxes have been resolved out of Court. It has been further submitted that the appellants and the respondent no.6 have availed of the benefit under the waiver scheme and the amount due in respect of the property in question in terms of the said scheme for the period till March 2020 have already been paid.

In view of the settlement arrived at between the appellants and the respondent no.6, the learned Advocate for the appellants, submits that the appellants do not wish to proceed with the instant appeal any further and prays for dismissal of the instant appeal as well as the connected applications for non-prosecution.

In view thereof, the appeal being A.P.O. No.50 of 2020 along with the applications being IA No: GA/1/2020 (Old No:GA/941/2020) and IA No: GA/2/2020 (Old No:GA/942/2020) stand dismissed as not pressed. The letter dated February 17, 2021 recording the terms of settlement between the appellants and the respondent no.6 filed by the learned Advocate for the appellants in Court today, be kept with the record.
