The matter was last heard on 15th February, 2023 and kept today. The petitioner has put the respondent no.1 on notice that the matter will be kept today, which is evident from a letter with the endorsement of the respondent no.1, which is placed on record.

The petitioner claims misconduct on the part of the respondent no.2, who is a practising lawyer in the Alipore Court. The petitioner sent a complaint to the Chairman of the respondent no.1, Bar Council of West Bengal in the form of a Complaint Petition on 13th January, 2022. The petition is part of the record.

It is evident that the Bar Council of West Bengal/respondent no.1 has not taken any steps pursuant to the complaint. It has also not been represented on any of the days when the matter was listed before this Court.

WPO/302/2023 is disposed of with a direction on the respondent no.1 to consider the application under the relevant statute filed on 13th January, 2022 and take appropriate steps on the application within a period of three weeks from the date of communication of this order. The respondent no.1 shall hear the petitioner before coming to any decision in respect of the steps which it proposes to take. The State Bar Council shall also pay due attention to the seriousness of the charges made against the respondent no. 2.
