The Court : This Court has gone through the report from the Registrar, Original Side dated 9th September, 2021. It appears from the said report that the office of the Commissioner of Police, Vijaywada has replied to the letter of the Registrar, General indicating that the warrant of arrest issued against A4, Sri Hanumanthu Rajeswara Rao, R/o 59A-8-9, Teachers Colony, Vijaywada could not be executed since no such person exists in the said area. It is also reported that the door number also does not exist at Kanuru Village, Vijaywada.
It also appears from the report of the Hare Street, Police Station that the Commissioner of Police, Greater Chennai has communicated to the 16th MM Court that no such person as Rathnam Subramaniam is available at the address. This Court is of the view that the Hare Street Police Station and the Chennai and Vijaywada Police have taken due steps to comply with the order of the 16th MM Court. In that view of the matter, no further relief can be granted to the petitioner under Article 226 of the Constitution of India.
The writ petitioner may take appropriate steps in accordance with law for enforcement of the warrants of arrest issued by the 16th MM Court to apprehend the accused persons. With the aforesaid WPO/154/2021 is disposed of without any order as to costs.
